Terms of Service

The agreement

These Terms of Service (“Terms”) are an agreement between you, or the organisation you represent (“you”), and Simple Code d.o.o. (“we”, “us”, “Granily”). They apply to your access to and use of the Granily web and mobile applications and our marketing website.

If you are entering into these Terms on behalf of a care home or company, you confirm that you have the authority to bind that organisation.

The service

Granily is software for running a residential care home: care records, rota and staffing, medications, incidents, risk alerts, training, and compliance. We provide the service on a subscription basis and may improve or change features over time.

We aim to keep the service available and reliable, but we do not guarantee uninterrupted access. Planned maintenance and service updates are communicated in advance where practical.

Accounts

• You are responsible for the accounts you create and the actions taken under them.
• Keep login credentials secure and restrict access to authorised staff.
• You control the roles and permissions of the users you add, down to the individual permission.
• Tell us promptly if you believe an account has been compromised.

Acceptable use

You agree not to:

• Use the service unlawfully or in breach of care regulations that apply to your home.
• Attempt to access data belonging to other organisations.
• Probe, scan, or disrupt the security or integrity of the service.
• Resell or provide the service to third parties without our written agreement.

Fees and payment

Granily is priced per home, not per user. Fees, billing frequency, and any optional setup services are agreed with you before you start. Subscription fees are payable in advance. Where local law requires, applicable taxes are added.

Your data

Your data remains yours. We process resident care data as your processor, under your instructions and our Data Processing Agreement. How we handle personal data is described in our Privacy Policy. You can export your data at any time, and we provide an export if you leave.

Liability

Granily supports the running of your home, but you remain responsible for the care you provide and for meeting your regulatory obligations. To the extent permitted by law, our liability under these Terms is limited, and we are not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law.

Termination

You can stop using the service and cancel your subscription in line with the terms agreed with you. We may suspend or end access if these Terms are seriously or repeatedly breached. On termination, we make your data available for export and then delete it in line with our Privacy Policy.
